These Terms of Service ("Terms") govern your access to and use of the VMTC website, www.vmtc.in ("Website"), and purchases made directly through the Website.

In these Terms, "VMTC", "we", "us" and "our" refer to VMTC India and the operator of this Website. "You" and "customer" refer to any person accessing the Website or purchasing products through it.

By accessing, browsing or using the Website, creating an account, contacting VMTC, or placing an order, you acknowledge that you have read, understood and agreed to these Terms, together with our Privacy Policy, Returns & Refund Policy and Shipping Policy, and the applicable product listing.

If you do not agree with these Terms, please do not use the Website or place an order.

Nothing in these Terms is intended to exclude, restrict or waive any mandatory right or remedy available to a consumer under applicable law.

1. ABOUT VMTC

VMTC is an Indian business engaged in the sale of vacuum cleaner accessories, pressure washer accessories, air purifier filters, machines and related products.

Certain VMTC products may be designed for use with machines manufactured or marketed by third-party brands.

VMTC is an independent seller and is not affiliated with, sponsored by, endorsed by, authorised by, or otherwise associated with any third-party brand referenced on the Website.

References to third-party brand names, trademarks, model numbers or product names are used solely for identification and compatibility-reference purposes.

2. ELIGIBILITY AND LAWFUL USE

You agree to use the Website only for lawful purposes and in accordance with these Terms.

You must not:

  • use the Website for fraudulent, unlawful or abusive purposes;

  • provide false, inaccurate or misleading information;

  • interfere with the security, operation or availability of the Website;

  • attempt unauthorised access to the Website, its systems or customer information;

  • misuse another person's information or account;

  • reproduce, copy, modify or commercially exploit Website content without permission;

  • place orders using stolen, fraudulent or unauthorised payment methods; or

  • engage in conduct that may harm VMTC, its customers, service providers or third parties.

VMTC may restrict, suspend or terminate access to the Website where reasonably necessary to protect the Website, VMTC, its customers or its legitimate business interests, subject to applicable law.

3. PRODUCT INFORMATION

VMTC makes reasonable efforts to ensure that product descriptions, photographs, specifications, compatibility information, package contents and other information displayed on the Website are accurate.

However, product information may occasionally contain typographical, technical, photographic, manufacturing or updating errors.

VMTC may correct errors or update product information where reasonably necessary.

Minor variations in colour, packaging, labelling, appearance or manufacturing may occur and shall not, by themselves, constitute a defect where the product supplied materially conforms to the applicable product description and specifications.

Customers should carefully review the complete product listing, specifications, compatibility information and package contents before placing an order.

The product listing applicable to the order at the time of purchase shall generally govern the product supplied.

4. PRODUCT COMPATIBILITY

4.1 Customer Responsibility

Compatibility must be verified before purchase.

The customer is responsible for checking the exact machine brand and exact model number against the compatibility information stated in the applicable VMTC product listing.

VMTC guarantees compatibility only where:

  1. the customer's exact machine brand and exact model number are specifically identified as compatible in the applicable product listing; or

  2. VMTC has specifically confirmed compatibility to the customer in writing before the order is placed.

If the exact machine brand or model number is not specifically listed, the customer should contact VMTC before placing an order.

4.2 Compatibility Must Not Be Assumed

Compatibility must not be assumed merely because:

  • the product looks similar;

  • dimensions appear similar;

  • the connector or attachment mechanism appears similar;

  • the machine belongs to the same brand;

  • the product works with another model;

  • the product appears to physically fit;

  • another website or third party suggests compatibility; or

  • photographs appear similar.

4.3 Unlisted Machines or Models

Where a customer purchases a product for a machine or model that is not specifically listed as compatible and does not obtain written compatibility confirmation from VMTC before purchase, VMTC does not guarantee compatibility.

Any resulting incompatibility will generally be treated as a customer compatibility-selection issue rather than a product defect, manufacturing defect or incorrect supply by VMTC, subject to applicable law.

4.4 Verification

VMTC may request reasonable information or evidence to assess a compatibility claim, including:

  • the exact machine model number;

  • photographs of the machine;

  • photographs of the existing part or attachment;

  • photographs or videos of the VMTC product;

  • installation photographs or videos;

  • order information; and

  • other reasonably necessary information.

5. ORDERS AND ORDER ACCEPTANCE

Submitting an order constitutes an offer by the customer to purchase the selected products.

An automated order confirmation or payment confirmation does not necessarily constitute final acceptance of the order by VMTC.

VMTC may cancel or refuse an order where reasonably necessary due to:

  • product unavailability;

  • pricing or listing errors;

  • technical errors;

  • duplicate orders;

  • suspected fraudulent activity;

  • payment verification issues;

  • materially incorrect product information;

  • incorrect or incomplete customer information; or

  • circumstances beyond VMTC's reasonable control.

Where VMTC cancels an order after payment has been successfully received, the applicable amount paid for the cancelled order will be refunded through the applicable payment channel, subject to applicable law.

6. PRICING AND PAYMENT

Prices displayed on the Website are as stated on the applicable product page and at checkout.

Applicable taxes, including GST where applicable, will be reflected as required during the checkout process.

Website orders are accepted on a prepaid basis through the payment methods made available on the Website.

Cash on Delivery (COD) is not available for orders placed directly through www.vmtc.in.

Online payments may be processed through third-party payment service providers. VMTC does not ordinarily receive or store complete card details, banking credentials or other sensitive payment credentials processed directly by the applicable payment provider.

7. SHIPPING AND DELIVERY

Orders are generally dispatched within 2 working days, subject to successful payment, product availability and any necessary order verification.

Estimated delivery is generally 5–9 working days after dispatch.

Dispatch and delivery periods are estimates and are not guaranteed delivery deadlines unless expressly stated otherwise.

Orders are currently shipped within India only.

8. DELIVERY ADDRESS AND CUSTOMER INFORMATION

Customers are responsible for providing accurate and complete delivery addresses, telephone numbers and other information necessary to process and deliver an order.

VMTC shall not be responsible for delays, failed delivery, return-to-origin or additional delivery attempts resulting from inaccurate, incomplete or outdated information supplied by the customer.

Where legally permissible, additional shipping or re-delivery costs arising from incorrect customer-provided information may be payable by the customer.

9. PACKAGE INSPECTION AND TRANSIT DAMAGE

Customers should inspect the external condition of a shipment at delivery.

Where reasonably possible, visibly damaged, opened or tampered packages should be refused at delivery and immediately reported to VMTC.

Transit damage should be reported within 7 days of delivery, together with relevant photographs or videos of the outer package, shipping label, internal packaging and damaged product.

Customers should retain the original packaging until the matter has been resolved.

A delay in reporting may make verification substantially more difficult and may affect the available remedy, subject always to applicable law.

10. RETURNS, REFUNDS AND REPLACEMENTS

Returns, refunds and replacements are governed by the VMTC Returns & Refund Policy, which forms part of these Terms.

Nothing in these Terms or policies is intended to remove or restrict any mandatory consumer right available under applicable law.

11. PRODUCT INSTALLATION AND USE

Customers are responsible for using products in accordance with their intended purpose and applicable product information.

Improper installation, forced fitting, modification, misuse, physical damage, use with an incompatible machine or use contrary to instructions may affect eligibility for a return, replacement or refund where such circumstances are attributable to the customer and subject to applicable law.

Customers should contact VMTC before cutting, forcing, modifying, gluing, drilling or otherwise altering a product.

Difficulty installing a product does not, by itself, establish that the product is defective.

12. USED, INSTALLED AND CONSUMABLE PRODUCTS

Products such as filters, bags and other consumable or hygiene-sensitive accessories may be subject to additional return conditions.

To the extent permitted by applicable law, VMTC may decline a return where a product has been used, installed, damaged, modified or otherwise altered and the issue is attributable to such use, installation, damage or alteration.

This does not affect any statutory remedy applicable to a genuine defect or non-conformity.

13. THIRD-PARTY BRANDS AND TRADEMARKS

Third-party trademarks, brand names and model numbers appearing on VMTC product listings are used solely to identify machines with which the relevant VMTC product may be compatible.

Unless expressly stated otherwise, VMTC is not the manufacturer, owner, licensee, authorised distributor, sponsor or affiliate of those third-party brands.

The use of a third-party trademark does not imply endorsement, sponsorship, approval, certification or affiliation.

14. INTELLECTUAL PROPERTY

Website content, including text, photographs, graphics, logos, product descriptions, layouts, designs and other materials owned or licensed by VMTC are protected by applicable intellectual-property laws.

You may not reproduce, copy, modify, distribute, commercially exploit or republish such content without prior written permission, except where permitted by applicable law.

15. CUSTOMER COMMUNICATIONS

Customers may contact VMTC through WhatsApp, email, telephone or other communication channels made available by VMTC.

Information provided through such communications may be used to process enquiries, compatibility requests, orders, returns, replacements, refunds and other customer-service matters in accordance with our Privacy Policy and applicable law.

VMTC may retain relevant communications and records for legitimate business, customer-service, fraud-prevention, accounting, legal and compliance purposes.

16. THIRD-PARTY SERVICES AND LINKS

The Website may use or link to third-party services, including payment providers, logistics providers and other service providers.

VMTC does not control third-party websites and is not responsible for their content, availability, privacy practices, security or terms.

Use of third-party services may be subject to the applicable third party's terms and policies.

17. DISCLAIMER OF WARRANTIES

To the maximum extent permitted by applicable law, the Website and its content are provided on an "as available" basis.

VMTC makes reasonable efforts to maintain accurate product information and Website functionality but does not guarantee that the Website will always be uninterrupted, error-free or available at all times.

Nothing in this clause limits any warranty, guarantee or consumer remedy that cannot lawfully be excluded.

18. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, VMTC shall not be liable for indirect, incidental, special, consequential or purely economic losses arising from the use of the Website or products.

To the extent legally permissible, VMTC's aggregate liability arising directly from a particular product purchase shall not exceed the amount actually paid by the customer for the product giving rise to the claim.

Nothing in these Terms excludes or limits liability or statutory rights that cannot lawfully be excluded or limited.

19. FORCE MAJEURE

VMTC shall not be responsible for failure or delay caused by circumstances beyond its reasonable control, including natural disasters, severe weather, war, riots, strikes, epidemics, governmental restrictions, transportation disruptions, courier failures, infrastructure failures, internet outages or other force-majeure events.

Where applicable law requires a remedy, mandatory consumer rights shall remain unaffected.

20. INDEMNITY

To the extent permitted by applicable law, you agree to indemnify VMTC against losses, liabilities, costs or expenses arising directly from:

  • your unlawful use of the Website;

  • your breach of these Terms;

  • materially inaccurate information supplied by you;

  • misuse or unauthorised modification of a product; or

  • infringement of VMTC's or a third party's rights by you.

This clause does not apply to the extent that the relevant loss is caused by VMTC's own unlawful conduct or cannot legally be transferred to the customer.

21. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by the laws of India.

Subject to any mandatory consumer jurisdiction or statutory remedy available under applicable law, courts having jurisdiction at Gurugram/Gurgaon, Haryana shall have jurisdiction over disputes arising from these Terms or transactions with VMTC.

22. SEVERABILITY

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it enforceable where legally permissible.

The remaining provisions shall continue in effect.

23. CHANGES TO THESE TERMS

VMTC may update these Terms from time to time.

The version applicable to an order shall generally be the version displayed or accepted at the time the order is placed, unless a change is required by law or expressly applies retrospectively in accordance with applicable law.
